Introduction and Regulatory Overview

The Hazardous and Special Products (HSP) Regulation that took effect on October 1, 2021, includes regulatory reporting requirements for haulers and processors of antifreeze, oil and antifreeze containers, and oil filters (Automotive HSP). Reporting requirements to AMS are detailed in your Service Agreements.

The HSP Regulation places full responsibility on Producers of Automotive HSP (and the PROs supporting them) to meet specific collection and management targets. Demonstrating that Producers and PROs met this responsibility requires accurate tracking of material movement from collection through to end market.

The Resource Productivity and Recovery Alliance (RPRA) is responsible for compliance and oversight of the HSP Regulation.

Importance of Reporting

Service Providers need to be aware of how to complete accurate AMS reports. Haulers and processors should also note they have regulatory reporting obligations to RPRA.

As multiple Service Providers are often involved in the hauling, consolidation and processing of Automotive HSP, consistent and accurate reporting is essential. AMS collects supporting documentation to ensure:

  • AMS can verify all material collected is managed by approved Service Providers
  • AMS has accurate data to track the management requirements outlined in the HSP Regulation
  • Timely approval of Service Provider claims.

Reporting to AMS

Different AMS reports are required depending on the services you provide to AMS.

AMS Haulers submit reports and claims related to the transportation of Automotive HSP from a collection site to an approved Processor. This may include:

  1. Transport Claims for Direct Moves that record material moved directly from collection sites to an approved Processor
  2. Bulk Move reports that record material that is transported and consolidated before being delivered to an approved Processor.

AMS Processors submit reports and claims for the recovery and diversion of Automotive HSP. This may include:

  1. Process claims that record the type and weight of materials received for processing.
  2. Diversion reports record the type and weight of material received for processing and how materials were managed at end of life.

Reporting to RPRA

Service Providers are required to submit reports to RPRA in accordance with the HSP Regulation. RPRA provides reporting guidance provided on its website and in the HSP Verification and Audit Registry Procedure.

AMS has aligned the WeRecycle Portal reporting categories with RPRA’s current guidance. This ensures the data you prepare and submit to AMS aligns to the reporting categories presented on RPRA’s reporting registry. AMS will aim to keep its information up to date with any changes or clarifications made by RPRA.

Ensuring Protection of your Commercially Sensitive Information

AMS does not require a Service Provider to share any commercially sensitive information with other Service Providers (such as details about collection sites that are part of a Hauler’s collection network).
